Q: What does this insurance cover?
A: DPEinsure™ covers your liability or alleged liability for accidents/incidents that occur during a checkride from the time you meet the applicant at the terminal to the time you meet to debrief after the flight at the terminal.
 
Q: Can I use DPEinsure™ for one flight only?
A: DPEinsure™ is an annual policy, the number of check rides you give during the policy period is up to you.
 
Q: If I am not the pilot in command how could they find me liable or partly liable for an accident?
A: Every accident is different from the next, a lot of factors can affect how liability is determined, for example:
  • Was the pilot being examined less experienced than you? Even if he/she caused the accident, a civil court of law could determine that the more experienced person in the aircraft, the DPE, could have done more...
  • Did the accident occur during a maneuver that differs from what other DPEs consider "normal" for the given check ride?
  • Were you performing a demonstration and controlling the aircraft when the accident occurred?
  • Did the flight take place in conditions that are generally considered "less than optimal"?
  • Was the order and pace of the maneuvers you requested a factor in the accident?
 
Q: I am a highly respected DPE that has always performed above standard and I follow the letter of the FAR's religiously, why would I need insurance?
A: Even if it is determined that you are not liable for an accident, the cost to defend yourself and prove your innocence can be very high. In addition, the insurance company claims staff knows what attorneys stand the best chance of success in an aviation related case - they don't want you to lose; it's their money on the line.
 
Q: I own an aircraft and the policy provides Non-Owned Aircraft Liability, wouldn't that provide coverage?
A: There are explicit exclusions in every aircraft policy; a common exclusion is the use of the aircraft for Flight Instruction to persons other than those named in the policy. An astute attorney could argue that giving a check ride is a form of flight instruction. There are two ways to make sure you are covered, the first is to ask your insurance company if your activity as a DPE is covered and to endorse it in the policy. The second is to obtain DPEinsure™.
 
Q: What if there is an accident in the vicinity of the aircraft but before the flight takes place? Will DPEinsure™ cover me?
A: DPEinsure™ can provide coverage during the check ride activities in and around the aircraft. The policy will defend and indemnify you for covered claims that occur in the vicinity of the aircraft before, during and after the flight.
 
Q: If there is an accident and I incur an injury and my flight gear is damaged, will DPEinsure™ help me with my expenses?
A: DPEinsure™ can provide coverage for Medical Payments, depending on the limit purchased. It also provides coverage for Baggage. This coverage can apply to all passengers.

Q: If somebody sues me because I passed an applicant who went on to have an accident after the checkride, am I covered?
A: Yes, if you purchase the additional endorsement called Negligent Instruction Endorsement buyback the policy will defend and indemnify you up to the policy limit as long as the accident/incident occurs during the policy year.
